The 341 Meeting and What is Involved

If you opt to file bankruptcy in the State of Florida, you will be required to attend a 341 meeting within approximately a month from the time your attorney files your petition with the court. At this meeting, the trustee, as well as any creditors who choose to attend, can ask you questions about your finances. Many clients experience a sense of apprehension about the 341 meeting, but the reality is that the hearing is non-adversarial in nature and is usually over in a few minutes. During the course of your hearing, the bankruptcy trustee will ask you questions to clarify and confirm the information that is written in your petition. Any creditors that will be affected by the bankruptcy may also attend, but in most cases, they forgo this option. If a creditor's representative or attorney does attend the 341 hearing, he or she cannot be abusive.
