How does a bankruptcy mortgage modification work?

When you are in a chapter 13 bankruptcy you can file a motion asking a judge to order mediation. In order to be eligible to have a mortgage modification you must propose to pay 1/3 of your gross monthly income to the mortgage company in order to show you are entering this modification in good faith. Once mediation is ordered, the mortgage company is required to review your mortgage and give you a modification if you are eligible for one. The reason this type of modification review is better than one you may have received when you were in foreclosure is that there is court oversight. Meaning the bank is monitored to ensure they are actually receiving all the required documents and evaluating your loan. You also get the chance to talk with the bank during court ordered mediation to ensure you understand all of the terms of your loan.
