What is a reaffirmation agreement?

When you file a chapter 7 bankruptcy you name is basically wiped off every financial agreement you’ve ever signed. In order to put your name back on that agreement you must resign that agreement, the resigning of that agreement is called a reaffirmation agreement. You are required to reaffirm any vehicle that you want to keep after the bankruptcy, but you are not required to reaffirm a home. You have a choice. If you do reaffirm a mortgage, your payments will report on your credit report and you are able to modify the mortgage in the future. If you do not reaffirm your mortgage, you are not personally liable on the debt, meaning that if the property ever goes into foreclosure the bank cannot seek a deficiency judgment against you.
